Terms & Conditions
1. Contract Conclusion and Booking
1.1 Booking Request: By submitting a booking request, you (the “Client”) are making a binding offer to yogatravel & beyond GmbH (“Yogatravel”) to enter into a travel contract based on the trip description, the detailed service description applicable at the time of booking, and these General Terms & Conditions. The booking request may be submitted orally, by telephone, in writing (including by fax), or electronically (via website or email).
1.2 Representation: If you are registering additional participants, you are responsible for their contractual obligations as if they were your own, provided you have expressly agreed to this.
1.3 Booking Confirmation: The travel contract is deemed concluded once Yogatravel confirms acceptance of your booking. This confirmation may be provided in any form. You will receive a booking confirmation and, where applicable, a legally required insolvency protection certificate in accordance with §651r BGB.
1.4 Deviations in Confirmation: If the booking confirmation differs from your initial request, it constitutes a new offer by Yogatravel, valid for 10 days. The contract is concluded if you accept this new offer within this period, either explicitly or through conclusive action (e.g., payment of the deposit).
2. Payment Terms
2.1 Deposit: A deposit of 20% of the total travel price is due immediately upon receipt of the booking confirmation and invoice.
2.2 Final Payment: The remaining balance must be paid no later than 28 days before the start of the trip, provided it is confirmed that the trip will take place. If payment is not received on time and following a reminder with deadline, Yogatravel reserves the right to terminate the contract in accordance with §323 BGB and charge cancellation fees.
3. Scope of Services and Pre-Contractual Changes
3.1 Contractual Services: The scope of services owed results exclusively from the booking confirmation and the detailed trip description as shown on the website or specific proposal.
3.2 Customized Travel: For individually arranged travel offers, only the specific services listed in the written offer and confirmation are binding.
3.3 Limitations of Third Parties: Service providers (e.g., hotels, airlines, seminar venues) and booking agents are not authorized to make agreements that go beyond or conflict with the contractually agreed services.
3.4 Pre-Contractual Modifications: Yogatravel reserves the right to make changes to advertised services and prices before conclusion of the contract for substantial and justified reasons, such as unforeseen increases in transport costs, taxes, or currency fluctuations. Any such changes will be clearly communicated before contract conclusion.
4. Post-Contractual Changes
4.1 Changes to Services: After the contract has been concluded, changes to essential travel services are only permissible if they are necessary, made in good faith, do not significantly alter the trip, and are reasonable.
4.2 Price Adjustments: Price changes are only permitted after conclusion of the contract if they result from increased transportation costs, government-imposed charges, or currency fluctuations.
4.3 Right of Withdrawal: If the price increases by more than 5% or a major service is significantly changed, you are entitled to withdraw from the contract without penalty or to rebook to an equivalent trip, if offered. This must be communicated promptly upon notice of change.
5. Cancellation by Client and Replacement Travelers
5.1 Cancellation by Client: You may cancel the travel contract at any time prior to departure. Notice of cancellation should be made in writing and becomes effective upon receipt by Yogatravel.
5.2 Cancellation Fees: Yogatravel may charge the following cancellation fees as a percentage of the total trip price:
- up to 60 days before departure: 20%
- 59 to 30 days: 40%
- 29 to 15 days: 50%
- 14 to 7 days: 75%
- 6 to 2 days: 90%
- From 1 day before departure or no-show: 100%
You remain entitled to prove that a lesser or no damage occurred. Yogatravel reserves the right to claim higher compensation, provided it is itemized and substantiated. Travel cancellation insurance is strongly recommended.
5.3 Substitution: You may designate a substitute traveler up to the start of the trip. Yogatravel may object if the substitute does not meet specific trip requirements or is barred by legal/regulatory reasons. You and the substitute are jointly and severally liable for the trip cost and any additional fees, especially for air transport, where name changes may not be permitted.
6. Services Not Used
No refunds will be granted for travel services not utilized for reasons attributable to the traveler (e.g., early departure, illness).
7. Cancellation or Termination by Yogatravel
7.1 Minimum Participants: Yogatravel may cancel the trip no later than 14 days before departure if the minimum number
of participants (as stated in the trip description and booking confirmation) is not met. In this case, all payments will be refunded. Any external services not included in the package (e.g., self-booked flights) remain your responsibility.
7.2 Termination for Misconduct: Yogatravel may terminate the contract without notice if your behavior severely disrupts the trip and you do not stop despite warning. In this case, the full trip price remains payable, though Yogatravel must offset any saved expenses or third-party refunds. Any additional return costs are borne by the traveler.
8. Force Majeure
If unforeseeable force majeure events (e.g., natural disasters, pandemics, war, official travel warnings) significantly impede, endanger, or impair the trip, both parties may withdraw from or terminate the contract. Refunds will be issued for unused services, subject to deduction of non-recoverable costs.
9. Governing Law and Jurisdiction
These Terms & Conditions and all travel contracts are governed by German law, excluding the UN Convention on Terms & Conditions of yogatravel & beyond GmbH
Contracts for the International Sale of Goods (CISG). For consumers with habitual residence in the EU or EEA, mandatory consumer protections in their home jurisdiction remain unaffected. Jurisdiction for business clients is Munich, Germany.
